Application for constitutional review of German Air passenger duty
German Federal Constitutional Court denies violation of German Constitutional Law.
Today, the German Federal Constitutional Court (Bundesverfassungsgericht) has decided that the German Air passenger duty introduced in 2011 is not contrary to German constitution as not breaching the principle of equality and the fundamental right of freedom to exercise a trade or profession neither of the airlines nor of the passengers.
Airlines awaiting this decision should re-consider whether they might have to register for German Air passenger duty.
